with this information notice, we wish to offer a clear and transparent view of what information we collect when the user is browsing the website and how we process the data as part of the relationship with website users, potential customers or existing customers, in compliance with the new general data protection regulation 2016/679 (hereafter gdpr or regulations) which, starting from 25 may 2018, is fully applied throughout the european union.

the objectives that we set ourselves, in particular, are:

• make sure that the website users, potential customers and existing customers understand what personal data we collect, for what purposes and for how long;
• explain in a clear and transparent way how we use the personal data that the users of the website, potential customers and existing customers, provide to us and with whom we share them, in order to offer an increasingly efficient service;
• explain to website users, potential customers and existing customers what their rights are (including the new ones introduced by the gdpr) and their possible choices regarding the processing of personal data, ensuring, on the one hand, greater control over them, and on the other hand, greater protection by Viabizzunoagricola soc. agr..

Viabizzunoagricola soc. agr., with registered office in via mentana 113 - 48022 lugo (ra), vat no. 02219320393, in the person of its pro tempore legal representative, is the data controller of your personal data (hereinafter referred to as the "data controller", or "Viabizzunoagricola").

what do we mean by personal data and what data do we process?

"personal data" means any information suitable for identifying, directly or indirectly, a physical person, in this case you, the user of the website, potential customer or existing customer (so-called data subject), who uses the services offered by Viabizzunoagricola.

in particular, we collect and process the following personal data necessary to fulfil the requests for contact and information sent via the website, as well as for any fulfilment of the obligations arising from the supply services offered, including any contractual or pre-contractual relationships established with customers:

• identification data: name and surname of the company, of the person or of the local representative;
• category of affiliation;
• contact details: residential address, landline and mobile phone number, fax number and email address;
• the data relating to preferences with regard to the specific types of products offered;
• in general, any other data and information necessary for the conclusion and execution of the contract (e.g. vat number, details of the bank account or bank accounts, credit card details).

we also collect your data on the website using cookies.

what are the purposes of the processing?

the data controller collects and processes personal data (hereinafter also "data") provided by users when completing the appropriate sections of the website, as well as those subsequently communicated:

a - to respond to contact and information requests regarding Viabizzunoagricola products;

b - for the purpose of pre-contractual activities, such as the management and execution of the contractual relationship established with you (administrative and accounting activities, customer support, complaint management, credit recovery) and the provision of services, closely connected and instrumental to it; these data are strictly necessary to execute the supply of products as requested by you;

c - to fulfil the obligations under the law (administrative, accounting, tax) and the requests from the authorities that the data controller is subject to;

d - to exercise the rights of the data controller, for example the right to defence in court.

providing your personal data for purposes a, b, c is essential for the management and execution of the contractual relationship and is therefore mandatory and does not require prior consent from you. a possible refusal to provide the above data, even if legitimate, would compromise the ability for Viabizzunoagricola to provide the supply services regarding the products requested by you.

e - for purposes of commercial promotion and marketing. in particular, with a view to continuous improvement of the customer experience and in order to offer services "tailored to you", we will process your data to:

• send you via email, mail and/or sms and/or telephone calls, newsletters, commercial communications and/or advertising material regarding the products and/or services offered by the data controller, or at events and fairs in which Viabizzunoagricola will participate.

providing your personal data for purpose e is optional, and prior and specific consent from you is therefore necessary, expressed in writing. failure to consent to the processing of personal data for the purposes referred to at paragraph e will not compromise or limit in any way the processing for the purposes referred to at paragraphs a, b, c, d and f.

what are the processing methods?

Viabizzunoagricola collects your personal data directly from you when you contact us at our website, or through social media such as "instagram", "facebook", as well as other third parties from which the data controller purchases databases, ensuring in advance the legitimacy of their acquisition.

in case of website browsing: Viabizzunoagricola collects your personal data when you register on www.viabizzunoagricola.com or send us an email through a contact form, or through the use of social media such as "instagram", "facebook", and when you contact us via phone.

in case of events and fairs: Viabizzunoagricola collects your personal data directly when you participate in trade fairs and events, when you fill in the appropriate contact form available at the company's stands.

in any case, regardless of the above methods of collection, we process your personal data in compliance with the principles of lawfulness and fairness and we always operate so as to guarantee the confidentiality and security of your information.

the processing of your personal data is carried out, both on paper and electronically, through the following activities: collection, registration, organization, structuring, storage, consultation, adaptation or modification, use, communication, extraction, comparison, linking, limitation, deletion and destruction of the data.

we also undertake to ensure that the information and data collected and used are adequate, relevant and limited to what is necessary with respect to the purposes described above, and that your personal data are processed in such a way as to ensure their security, also through adequate and effective technical and organizational measures implemented by the data controller, in compliance with the principle of accountability required by the new eu regulation, which prevent the risk of loss, unauthorized access, illicit use and dissemination thereof.

these measures guarantee, in any case, that access to your personal data is allowed only to persons authorized by the data controller, as well as to third parties appointed as data processors.

for how long and where do we store your personal data?

we retain your data only for the time necessary to perform the processing for the purposes mentioned above. in particular, for the purposes referred to at paragraph a, ​​we will not process your data beyond 24 months after the last access.

for the purposes referred to at paragraphs b, c and d, we will process your data for the duration of the contract and until there are obligations or requirements related to its execution up to 10 years after the termination of the contractual relationship to fulfil legal obligations or for the defence of our rights.

however, if the data controller has documented the need to retain data for a period of more than 10 years, for the exercise of the right of defence, your data may be retained until the definitive conclusion of the judgement. in this last case, access to your personal data will in any case be limited solely to the officer in charge of Viabizzunoagricola's legal department.

for purposes of commercial promotion and marketing, pursuant to paragraph e, exercised prior to your explicit consent, we will retain your data up to a maximum of 7 years from its collection (in compliance with the principles of pertinence, non-excess of data and limitation of retention), at the end of which the data must be automatically deleted or made anonymous in a permanent and non-reversible manner, except for the exercise of the right to oppose the processing for marketing purposes on your part or the revocation of the previously expressed consent.

in any case, your personal data will be stored either (or both) on adequately secured servers located within the european union, and on hardcopy through filing in suitable lockable fireproof cabinets whose access is reserved only for parties authorized by the data controller.

who do we communicate your personal data to?

we communicate your data exclusively to the parties (authorized processing representatives and appointed external data supervisors or recipients by law) that we rely on for the execution of activities necessary for the achievement of the purposes described above, for the execution of the services requested by you, that is, for purposes strictly connected and instrumental to the management of the pre-contractual relationship, to the execution of the contractual relationship, and to the administrative and accounting management after the end of the relationship, in particular:

• to companies or other third parties (lending institutions, professional firms, consultants, legal auditing firms, communication agencies, etc.) that perform outsourcing activities on behalf of the data controller;
• to public authorities, supervisory bodies or judicial authorities for the fulfilment of legal obligations.

where do we transfer your data?

as a rule, we do not transfer your data outside the european union. the data controller, however, reserves the right, if necessary, to transfer your data outside the eu but, in this case, guarantees as of now that this will be done in accordance with applicable legal provisions, including through the provision of standard contractual clauses provided by the european commission. in particular, the transfer to countries outside the european union may take place where necessary for the conclusion or execution of a contract between the data controller and another natural or legal person in favour of the data subject pursuant to art. 49 par. 1 subpar. c of the regulations.

what are your rights as data subject?

pursuant to articles 15, 16, 17, 18, 19, 20, 21 and 22 of eu regulation 2016/679, at any time you may exercise the following rights towards the data controller.

• right to access: the right to obtain confirmation of the existence or otherwise of data processing concerning your data as well as the right to receive any information relating to that processing;
• right to correction: the right to obtain the correction of your data, if they are incomplete or inaccurate;
• right to deletion (so-called "right to be forgotten"): in certain circumstances covered by the regulations, you have the right to obtain the deletion of your data from our archives if they are not relevant to continuing the contractual relationship or if required by law;
• right to processing limitation: if certain conditions occur, you have the right to obtain a limitation of the processing, if it is not relevant for the purpose of continuing the contractual relationship or if required by law;
• right to data portability: the right to obtain the transfer of your data to a different data controller;
• right to withdrawal of consent: the right to withdraw consent to the processing of your data for commercial and/or advertising purposes, at any time, without prejudice to the lawfulness of the processing based on consent before revocation;
• right to submit a complaint to the supervisory authority: at any time, you have the right to submit requests for the exercise of your rights. in any case, if you wish to lodge a complaint about how your data are processed or about the management of a complaint you submitted, you have the right to submit a complaint directly to the supervisory authority.

the above rights may be exercised against Viabizzunoagricola soc. agr., in its capacity as data controller, by writing to vendite@viabizzunoagricola.com, or by sending a registered letter to the registered office.

the exercise of your rights as a data subject is free under article 12 of eu regulation 2016/679.

changes to our privacy policy

the data controller reserves the right to modify and/or implement this privacy policy, also due to legislative changes subsequent to the pre-contractual or contractual relationship established with you, or recommendations, general authorizations, guidelines, and additional guarantee measures indicated by the italian or european privacy authority, but always in order to provide greater protection for the processing of your personal data. the aforementioned changes will take place only after informing you by notification on our website, or, if this is not technically possible, by sending a written notification to one of the contact details available to Viabizzunoagricola soc. agr.

if the modifications concern any processing whose legal basis is consent, the data controller will collect your consent again, if necessary.
